Will of   Joseph Repine

Will Book 1, pg. 384         "1841"

#618 Joseph Repine, Deceased. I Joseph Repine of the Township of Blacklick, County of Indiana, Pennsylvania do make and publish this my last will and testament. And first I direct that my body be decently interred and that my funeral be conducted in a manner corresponding with my estate and situation in life. And as to such worldly estate as it hath pleased God to intrust me with I dispose of the same as follows. First, I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first monies that shall come into the hands of my executors from any portion of my estate. Also I direct that a fair valuation appraisement be made of all my personal estate. Also I do direct that the whole of my house hold furniture (excepting such articles here in after directed to be sold) shall be and remain the absolute property of my beloved wife and children for their mutual comfort & convenience in the occupancy of the Mansion house while she remains my widow unmarried and the same be distributed among them as is hereinafter directed and further -
Item 1st I will & bequeath unto my beloved wife Mary Jane (over & above what the law would allow her out of my estate real & personal) the Bureau she brought with her and the Bay mare saddle & bridle.
Item 2nd I will and bequeath unto my beloved daughter Rachel one good bed & bedding and bedstead, two cows and six sheep when she needs them or when she arrives at the age of twenty one years, the cows and the sheep to be taken out of the proceeds or increase of the stock left on the farm for the use of the family the grey mare now on the farm, her saddle & bridle my **n Bureau and a sild dress as soon as prudence and convenience will allow here to get her mare to be used by the family and supported on the farm.
Item 3rd It is my will that my beloved daughter Catherine receive (at the proper time when she may need or when she arrives at the age of twenty one years) out of my estate as much and in all respects be set off equal in kind and quality of property with Rachel’s portion.
Item 4th I will and bequeath unto my son Joseph my new suit of clothes my green over coat and *at and cap. I also direct that the remainder of my clothing be sold.
Item 5th It is also my will that my wife’s daughter Eliza Ann Wallace may be maintained on the farm with my own and as my own children while she sees proper to stay with them and should she remain in the family until she marries or arrives at the age of twenty one years that she *** receive out of the proceeds of the farm, one cow, one bed and bedding and bedstead.
Item 6th I will and bequeath to my two sons Joseph and David all of my real estate which I direct to be divided equally between them according to quality and quantity each to share and share alike and should either die before he becomes of age I will that his part or portion of such fall to the surviving Brother and should Henry ?Our? Fail in paying for the land he bought of me & it fall back to my estate in that case I direct that it be divided with my other land betwixt my sons Joseph and David aforesaid. But should any of my daughters die before she arrives at the proper age then let her portion fall to her surviving sister and if Henry ?Our? Should make good the payment for the land let the money together with any surplus that may be after paying my debts be divided equally among all my children each share and share alike. And further I also direct that the mantle clock desk and gun be put to sale and that the Books be kept for the use of the family. And also I direct that for the (last line on page unreadable) as will support the family for one year and hay & feed for the Beasts one year, four cows one axe one mattock one hoe all the needed spring - house furniture, the orchard for the use of the family, all the wood and all the shoes they may need for one year also all the Bags and a web of bagging now ready to weave & two sets horse geers the best. And I do hereby make and ordain my neighbors William McCrea and Joseph Smith, Executors of this my last will and testament and direct that my grave stones may be taken out of any surplus after payment of my debts. But finally that it come out of my sons portions. An I will and appoint George Rankin and Hugh McClarren to have the guardianship of my children during their minority. In witness whereof I have set my hand and seal the tenth day of August in the year of Our Lord one thousand Eight hundred and forty one. {seal}

After more due consideration and reflection I will and bequeath to my daughters Rachel & Catherine out of my real estate to each & each one respectively the sum of one hundred and twenty five dollars, to Rachel one hundred and twenty five and to Catherine one hundred and twenty five when David becomes of age to inherit his portion or when Joseph becomes of age should David die a minor and be the case then with Henry ?Our? As it will or may the get only one hundred and twenty Dollars each out of the real estate, I also direct that the two stoves remain with the family.

4th of Sept 1841 upon further consideration of the disposal of my worldly affairs I will and direct that my two daughters Rachel and Catherine shall receive out of my real estate two hundred and fifty dollars each respectively instead of the one hundred and twenty five as before directed and still further that my youngest son within named David shall be hereafter called James Wilson Wallace and receive as before directed to be done by this my will and within written when we called him David. And also that all the flax be put to the use of the family at their discretion again. I also direct that my daughter Rachel be paid out of my personal property when she arrives at the age of twenty one years the sum of fifty Dollars provided there be so much of a surplus after paying all my debts and should there be no surplus after paying my debts that she then receive out of my real estate over and above the two hundred & fifty Dollars as before directed fifty Dollars when James Wilson Wallace comes of age. Witness my hand and seal the day and year above written.

Be it remembered that on the Eleventh day of September A.D. 1841. Before me Isaac M. Watt Register for the probate of Wills and granting Letters of Administration in and for Indiana County was duly proved and approved the foregoing last will and testament of Joseph Repine decd by the Oaths of Robert M Gee, Hugh McClarren & Daniel Zach the subscribing witnesses thereto. Same day Letters Testamentary was issued to William McCrea and Joseph Smith the Executors in said will named.
